Case Summary
On January 27, 2020, Emmanuel Yakubu was given an eight-year prison sentence by Justice Umaru Fadawu of the Borno State High Court in Maiduguri, and he was also told to pay his victim N12,300,000.00 (Twelve Million, Three Hundred Thousand Naira) in restitution.
Full story
The Economic and Financial Crimes Commission, EFCC, Maiduguri Zonal office prosecuted the defendant, the CEO of the non-profit Young Aid International Humanitarian, on a single count of obtaining money under false pretenses in violation of Section 1(1)(a) of the Advance Fee Fraud and Other Fraud Related Offenses Act, 2006.
Yakubu's journey to prison began when the EFCC received a petition against him from a man named Kieran Felix Zirra. In the petition, Zirra claimed that sometime in March 2019, a man named Moses Bulus (who is now a prisoner) approached him with a fictitious purchase order for the supply of emergency shelter kits worth more than N19 million. According to the EFCC investigation, Zirra provided the emergency kits on April 9, 2019, and Young Aid International Humanitarian's logistic officer delivered and verified their delivery.
The charge reads: "That you, Emmanuel Yakubu Usman, while serving as the Head of Mission and Executive Director of Young Aid International (Non-Governmental Organization) with the intent to defraud, obtained the sum of N10,000.000.00 (Ten Million Naira) from one Kieran Felix Zirra into your corporate account, Mega-Scale Global Enterprises with account No. 008569089, domiciled in Maiduguri, Borno State sometime between April 2019."
The convict pleaded not guilty to the charge, prompting his trial. In the course of the trial, prosecution counsel, Benjamin Manji presented six witnesses and tendered several documents as exhibits in court.
