Professor Richard Iyiola Akindele, who was hitherto a lecturer at the department of Management Accounting of the Obafemi Awolowo University, Ile-Ife, had on 16th September, 2017 unlawfully demanded sexual benefits in exchange for marks from one of his students, Monica Osagie. The unfortunate occurrence was however captured on a hidden camera and surfaced on the internet. This led to his dismissal from the university as a lecturer.
The Independent Corrupt Practices Commission (ICPC) jumped on the matter and arrested the errant lecturer for his corrupt utterances and escapades. He was arraigned before Honourable Justice Maureen Onyetenu of the Federal High Court on a four-count charge on the 19th November, 2018.
According to the Prosecutor, the defendant corruptly asked for sexual benefits from Ms. Monica Osagie on account of favour to be afterwards shown to her in the discharge of his official duties as a lecturer, to wit: altering her academic grades from fail to pass in his course, MBA 632- Research Method. The offences contravened Sections 8(1)(a), (2) and 18(d) of the Corrupt Practices and Other Related Offences Act 2000 and punishable under same sections.
During the course of the trial, the accused via his counsel attemoted to enter into a plea bargaining agreement with the prosecution in return for a lighter sentencing. The efforts made by the former lecturer’s lawyers to suspend the sentencing and negotiate for plea bargain however failed, as Justice Onyetenu frowned at the rampant cases of students’ harassment by lecturers.
Justice Onyetenu in her final judgment delivered on the 17th December, 2018 noted that a plea bargain is not absolute, and the court still has a discretion to accept a plea bargain or not. She then noted that regardless of the plea bargain arrived at by the parties, Akindele should be used as a scapegoat to deter higher institutions’ lecturers in the habit of molesting students because of sex from engaging in such acts. The judge insisted that plea bargaining could apply when public interest was involved, and stressed that the public interest in this case was against Akindele, because many female students of higher institutions had been turned into sex slaves by their lecturers.
The learned justice then sentenced Akindele to 24 months jail term for asking Monica for a sexual benefit and handed him another 24 months jail-term for soliciting from the victim sexual benefit to pass her. The visibly annoyed Justice Onyetenu also dished out another sentence of 12 months jail term to Professor Akindele for deleting parts of the WhatsApp conversation between him and Miss Osagie to conceal evidence against him, and sentenced him to another 12 months jail term for falsification of age. The total jail term handed to the fomer lecturer totaled six years. The jail terms are to run concurrently, meaning Onyetenu would spend two years behind bars.
